金融創新下洗錢防制之研究-以虛擬通貨為核心

近年來金融科技的興起，科技創新下產生的「虛擬通貨」，被不法分子利用，透過各種不同的手法將其連結至原有的金融體系達到洗錢的目的，而因應科技的進步伴隨而來的犯罪手法也跟著升級，被認為有正視的必要性，近年各國也陸續祭出新的監理規範及法規政策，包含牌照化管理、課稅問題、法令遵循等，面對來勢洶洶的虛擬通貨，各國亦不斷的修正調整相關法規範，以保護投資人及業者，而我國前於2018年11月7日修正洗錢防制法，將虛擬通貨平台及交易業者納入法規管制，為台灣首部明文對虛擬通貨進行監管之法規，然而雖然已將其納入法規範，但對於其定義、性質、特性、應受監管之類型及相關服務商營業等規範無明確定義，以至業者無明確法規範可遵

循，致業者難以執行、遵循洗錢防制政策。行政院於2021年指定金融監督管理委員會為本事業之洗錢防制主管機關，並於同年4月7日指定虛擬通貨平台及交易業務事業之範圍，爰參酌FATF發布之建議，訂定「虛擬通貨平台及交易業務事業防制洗錢及打擊資恐辦法」，同年6月30日金融監督管理委員會金管銀法字第11002720401號令訂定發布《虛擬通貨平台及交易業務事業防制洗錢及打擊資恐辦法》全文共18 條；除第7條另定施行日期外，自110年7月1日施行。本文首先透過瞭解洗錢行為與虛擬通貨運作之概念，並分析虛擬通貨與洗錢防制之關聯性，以了解虛擬通貨如何運用於洗錢活動之中，進而介紹洗錢防制及打擊資恐之國際公約及規範，

及其交易所造成的國際衝擊和問題，並参考世界各國的監管制度及較完善的洗錢防制機制，以檢視我國現行法對於洗錢防制之發展及針對虛擬通貨交易政策，以提出未來監管之方向及建議，期許我國在虛擬通貨之法規及監管上能有較完善的法規體系。
