基於合意之事件處理程序—以公平交易法第二十八條為中心

高通公司居於行動通訊標準必要專利權人地位所為之特殊商業運作模式深受世界各國競爭法主管機關注目,臺灣公平交易委員會亦曾作成行政處分認定高通公司行使專利權之行為,違反公平交易法之規定。惟於高通公司不服前開處分所提起之行政訴訟中,公平交易委員會竟與其達成訴訟上之和解,此舉引起各界議論。本文遂以高通案為背景,釐清公平交易委員會與高通公司之和解性質為何,並審查其合法性,同時指出目前以締結行政契約作為公平交易法上基於合意之事件處理程序有所不足。因此,擬以日本獨占禁止法上之承諾程序為觀察對象,比較其與臺灣公平交易委員會和解程序之異同,再於此基礎上,提出公平交易法之修法建議。

隨著近幾年來人工智慧的興起,各領域的專家學者們致力於研究人工智慧、機器學習與深度學習來驅動各種創新技術的實現。由於人工智慧系統需要執行大量的資料運算,導致對電腦速度的要求越來越高,若使用將中央處理器(CPU)與記憶體分開的傳統馮紐曼架構電腦,在CPU與記憶體之間資料傳輸的過程需消耗相當多的時間與功率,導致系統面臨資料處理速度緩慢與大量功耗的問題,這個現象稱作逢紐曼瓶頸。為了解決這個問題,記憶體內運算這個概念被提出,將需要處理的資料運算在記憶體內完成,減少資料需要在CPU與記憶體之間傳輸的次數,因而大幅減少功耗與資料傳輸的時間。近幾年來各式各樣的記憶體內運算電路被提出,其中有許多設計使用靜態隨

機存取記憶體(SRAM)陣列中的記憶體單元電流來完成記憶體內運算,然而由於受到製程漂移的影響,記憶體陣列中的每個記憶體單元電流並不相同造成運算結果產生錯誤。為了解決這個問題,本論文利用90nm CMOS實現了一個測試電路以測量一容量為8kb之8T SRAM陣列中每個記憶體單元之I/V電氣特性,據以了解製程飄移對使用SRAM陣列執行記憶體內運算的影響,並藉由量測結果決定出記憶體內運算電路合理的設計規格,避免過度設計浪費成本與功耗。
